These terms of business apply to all work carried out by Verdure Arborists ("we", "us", "our") for any client ("you", "your"). By accepting a quotation, whether in writing, by email, or verbally, you agree to be bound by these terms.
1. Quotations & Acceptance
- All quotations are valid for 30 days from the date issued, unless stated otherwise.
- A quotation is based on a visual site assessment at the time of the visit. If ground or access conditions change, or additional work is identified once on site, we will discuss this with you before proceeding and may need to revise the price.
- Work is confirmed once you accept the quotation in writing (including by email or text message).
2. Access & Site Conditions
- You are responsible for ensuring reasonable access to the work site, including informing us of any underground services, septic tanks, or other hazards not visible at the time of quoting.
- Where a neighbouring property needs to be accessed to carry out the work safely, it is your responsibility to arrange this in advance.
3. Permissions & Tree Preservation Orders
- It is your responsibility to confirm whether a tree is protected by a Tree Preservation Order (TPO) or lies within a Conservation Area, unless you have specifically instructed us to check this on your behalf as part of the quotation.
- Where we submit an application to the local authority on your behalf, this is subject to the council's own timescales and decision, which are outside our control.
- We accept no liability for penalties arising from unauthorised work on a protected tree carried out on your instruction.
4. Working Hours & Weather
- Work is normally carried out between 8:00am and 5:00pm, Monday to Saturday, unless otherwise agreed.
- We reserve the right to postpone work in the event of unsafe weather conditions (high winds, storms, ice, etc). We will contact you as soon as possible to rearrange.
5. Health & Safety
- All work is carried out in line with current UK health and safety legislation and industry best practice (AFAG guidance).
- For your safety, we ask that you, family members, pets and vehicles remain clear of the work area while works are in progress.
- Risk assessments and method statements (RAMS) are available on request, particularly for commercial and contract work.
6. Payment Terms
- Unless otherwise agreed in writing, payment is due within 7 days of completion of the work.
- For larger projects, we may request a deposit prior to work commencing, with the balance due on completion.
- Late payments may be subject to statutory interest under the Late Payment of Commercial Debts (Interest) Act 1998, where applicable.
7. Cancellation
- You may cancel or reschedule a booking by giving at least 48 hours' notice.
- Cancellations made with less than 48 hours' notice may be subject to a reasonable charge to cover costs already incurred (e.g. crew, plant hire, or crane bookings).
8. Liability & Insurance
- We hold public liability insurance of £5,000,000 and employers liability insurance of £10,000,000. Certificates are available on request.
- We take reasonable care to protect surrounding property, but cannot accept liability for pre-existing damage, or damage arising from conditions not reasonably foreseeable at the time of the site visit (e.g. hidden drains, cabling, or structural weaknesses).
- You should ensure your own property insurance is up to date prior to work commencing.
9. Waste & Arisings
- Unless otherwise agreed, all arisings (branches, brash, and timber) are removed from site and responsibly recycled or chipped.
- If you wish to keep logs, chippings, or timber, please let us know before work begins.
10. Guarantee
Trees are living organisms, and while we carry out all work to a professional arboricultural standard, we cannot guarantee the future health, growth, or survival of any tree following pruning or other works, as this depends on factors outside our control (weather, disease, soil conditions, etc).
11. Governing Law
These terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
This is a general set of terms of business and does not constitute legal advice. We'd recommend a solicitor reviews this before it's treated as final and binding.
